Our client is a middle-aged man who was charged by the NSW police for 14 firearms charges. He was granted bail and waited almost 4 years for his matter to proceed to trial due to the COVID 19 delay.
Charges Against Our Client
The charges against our client were extremely serious and related to 14 firearms found by the NSW police at another home. After a lengthy investigation, the NSW police also charged our client.
The NSW police relied on a multitude of circumstantial evidence against our client, including forensic and expert evidence to allege our client was in possession of the 14 firearms located by them.
Finally, the matter was listed for trial at Parramatta District Court.
What We Did
Our principal criminal defence lawyer, Mohammad Khan, obtained the police brief of evidence and provided advice to our client to the nature of charges and the evidence relied upon against him. After receiving the advice our client maintained a plea of not guilty to all charges. The matter was finally listed for trial and with the assistance our of team of barristers, we wrote to the DPP outlining the weaknesses in their case and the reasons the charges against our client should be withdrawn.
Although, this letter was sent, the DPP did not withdraw the charges against our client and continued prosecuting our client.
Outcome
However, before the trial was to commence, the Director of Public Prosecution (DPP) decided to withdraw all charges against our client. Accordingly, the Court dismissed all charges against our client and he was free.
